Basic Terms of Service (Early Launch)
These Terms of Service ("Terms") govern your access to and use of Jwelly Studio (the "Service"), available at https://studio.jwelly.ai (the "Site"). The Service is operated by MMI Softwares Pvt Ltd ("Company", "we", "us", "our") in India.
By accessing or using the Service, you agree to these Terms and the policies referenced below. If you do not agree, do not use the Service.

1. Eligibility
- Age requirement: You must be at least 18 years old to use the Service.
- Business use: If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. Accounts and security
- You may need an account to use certain features.
- You are responsible for activity on your account and for keeping your login credentials secure.
- Tell us promptly if you suspect unauthorized access to your account.
3. The Service (early launch)
The Service allows you to upload product images and generate AI-assisted images and videos.
The Service may change over time. We may add, modify, or remove features, including credit costs, for operational, security, or product reasons.
We do not guarantee uninterrupted availability. Maintenance, outages, and third-party dependencies may cause downtime.
4. Credits, pricing, and payments
Credit system
Paid features use a prepaid credit system ("Credits"). When you use paid features, Credits are deducted from your wallet balance.
Payments
Payments are processed via Razorpay. You authorize us and Razorpay to charge your selected payment method for your purchase.
Pricing changes
Prices and credit costs may change. If we make a material change to pricing for existing users, we will provide notice (for example, via email or within the Service).
No cash value; non-transferable
Credits have no cash value, are non-transferable, and cannot be resold.
Refunds
Refunds (if any) are handled according to our Refund Policy.
In general, credit purchases are digital goods delivered immediately and are non-refundable, except where required by law or where described in the Refund Policy.
5. Your content and AI outputs
Your content
You may upload images and other materials ("User Content"). You represent that you have all rights needed to upload and use that content in the Service.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and use your User Content only to provide and improve the Service (including generating outputs based on your inputs).
We do not use your User Content or AI Outputs to train our own AI models. However, third-party providers we use to deliver the Service may have their own data usage policies (see our Privacy Policy for details).
AI outputs
As between you and us, you own the outputs generated for you from your User Content ("AI Outputs"), subject to:
- These Terms
- Any applicable third-party provider terms (for example, model/provider platform terms)
Non-uniqueness
AI Outputs may not be unique. Similar inputs from other users may produce similar outputs.
Feedback
If you provide feedback, you allow us to use it without restriction or compensation.
6. Acceptable use
You agree not to misuse the Service. For example, you will not:
- Illegal / harmful / deceptive use: Use the Service for illegal, harmful, deceptive, or abusive purposes
- Rights and permissions: Upload content you do not have rights to use
- IP / advertising compliance: Generate content that infringes others' intellectual property or violates applicable advertising/consumer laws
- Security / reverse engineering: Attempt to reverse engineer the Service or bypass security or usage limits
- Automation: Use bots/scrapers to access the Service without our written permission
We may remove content, restrict generation, suspend features, or terminate accounts if we believe there is misuse or legal risk.
7. AI and jewellery disclaimers
The Service uses AI and may produce inaccurate, incomplete, or misleading results.
- AI Outputs are not verified for accuracy
- You are responsible for reviewing and verifying any generated marketing material before publishing
- AI Outputs are not professional advice (including gemological, appraisal, legal, or regulatory advice)
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Third-party services (payment processors, hosting, AI providers) are outside our control and may fail or change.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR AI OUTPUTS.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- The amount you paid to us in the 12 months before the event giving rise to the claim, OR
- ₹5,000
10. Termination
- You may stop using the Service at any time.
- We may suspend or terminate access if you violate these Terms, misuse the Service, or if required for safety/security/legal reasons.
- If your account is terminated for violation/misuse, unused Credits may be forfeited (subject to applicable law and the Refund Policy).
11. Governing law and courts
These Terms are governed by the laws of India.
If you have a dispute, please contact us first at support@jwelly.ai and try to resolve it informally.
If a dispute cannot be resolved informally, you and we agree to submit to the exclusive jurisdiction of the competent courts located where the Company's registered office is situated (India).
12. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on the Site. If changes are material, we will provide notice through the Service or by email where reasonably practicable.
